We are reaching out to follow up about a discussion that we started during the AE call on Monday 5/18. As mentioned, we were made aware that the Tennessee Association of REALTORS® recently received a subpoena asking them to demonstrate their compliance with the NAR settlement/rule changes that happened in 2024 (related to the Sitzer/Burnett case). To our understanding, Tennessee’s subpoena is similar to requests that other state and local associations and MLSs received last year (a copy of those request is attached for reference). 

AAR is working with counsel to determine what assistance we would be able to provide to our local associations if you receive a similar request. To that end, please send us the name and contact information for your association’s attorney as soon as possible. If you receive a subpoena or other request to demonstrate your compliance, please contact AAR immediately.
